TERMS & CONDITIONS

These terms and conditions apply to all orders placed with Willow Sports Wear Ltd

Refunds:
Due to the customized nature of the products, refunds are not available on customized orders unless the products are defective. If you believe your products are defective you must contact Willow Sports Wear Ltd. immediately. Returns will not be accepted if products have been used, worn or washed.

Delivery:
Any short deliveries must be notified to the carrier and Willow Sports Wear Ltd immediately and in writing within 3 days. Damaged or opened cartons must be checked or refused on delivery. Please note delivery dates quoted are a guide only and will not be legally binding unless specified as part of a contract.

Artwork:
No artwork will be returned unless requested. Screen charges relate to the production of positive films used to create an image on our screens. The image remains the copyright of the customer; the screen, films and embroidery disks remain the property of Willow Sports Wear Ltd. All films are stored for an indefinite period free of charge.

Prices and payment:
Willow Sports Wear Ltd reserves the right to alter prices and garment specifications without prior notice. All items remain the property of Willow Sports Wear Ltd. until paid for in full. Returned cheques will be charged at £25.00 per representation.

Changes to the site: We reserve the right to make changes to this site, the disclaimers and these terms and conditions at any time.

Agreements:
These terms and conditions form the basis of the legal agreement (“supply agreement”) under which we, Willow Sports Wear Ltd will supply to you goods and items which you have ordered from us and we have agreed to supply to you.

It is illegal to reproduce unlicensed trademarks or logos onto products within the Willow Sports Wear Ltd. The exclusive use and reproduction of such images lie solely with the legal owners. In addition, unlicensed copyrighted material from photographers, artists, authors and writers of original works, cannot be reproduced within the Willow Sports Wear Ltd site. Each order will be a separate agreement between us.

We will be entitled to cancel a supply agreement at any time if you have exceeded or will exceed your authorised credit limit with us, or if any invoices rendered to you for goods previously supplied are overdue. These are the only supply terms and conditions

Specification of goods
All goods are subject to availability. We can cancel a supply agreement, or offer alternative items, if goods ordered are out of stock or no longer available.

All description and other details provided in relation to goods are subject to confirmation by us and may be changed without notice. All sizes are approximate “to fit “sizes and are given as a general guidance only. Colour, shades, materials and sizes of goods may vary to a minor extent from those illustrated.

We will rely upon your orders being correct in entering a supply agreement and reserve the right to refuse to take back goods which are ordered in error or unused. You are to pay us a handling fee of 10% of the invoice value of the returned goods, plus VAT.

Bespoke goods are non-returnable (included decorated garments).

Prices and payments
The price for the goods shall be the price or prices specified by us in any relevant quotation tender or estimate or shall be the price or prices specified in our current price list. Pack and Carton Rates based on one colour, one size. We reserve the right to revise our prices at any time without prior notice.

Unless we expressly state otherwise in writing, all prices are ex-works and are exclusive of carriage postage packaging insurance value added tax and any levy or other tax which may be payable in respect of goods. The contract price will be inclusive of carriage for orders £250 or more (not taking into account VAT) to be delivered within England Wales or Scotland. Otherwise carriage will be charged at £10 plus VAT per delivery and postage will be charged at £3.95 plus VAT per postal packet. We reserve the right to revise these charges at any time.

You are to pay the contract price plus carriage postage and any other ex-works items specified in the invoice within thirty day after the relevant invoice has been sent to you. For customers without an account you are required to pay in full before delivery of goods. A payment is to be made in full in pounds sterling in cash or cleared funds without deducting or setting-of any amounts that we may owe to you.

Any payments received from you for goods supplied may be appropriated by us and applied towards discharging any amounts owed to us by you in respect of any goods previously supplied where payment is overdue and if so applied will not be deemed to have been received for the goods for which those amounts were tendered.

If you pay be credit, we reserve the right to make an additional charge to cover any additional administrative expenses that may thereby incur.
Represented cheques will incur a £25 charge.

Delivery and collection
Delivery of the goods will be deemed to have taken place: -

Upon you collecting goods from our premises. Collection times are between 9.00am and 5.00pm on a working day immediately upon us delivering the goods to any agreed or usual place of delivery.

You must accept all deliveries of goods, which have been ordered and are in good conditions.
If we are to deliver the goods to you within UK them we will arrange for delivery before noon after 3 working days.

If we are to deliver the goods to a non mainland UK address them we will use all reasonable efforts to deliver within 14 days after the order date.

If we deliver the wrong, or damaged goods to you then you are to notify us within 48hours of delivery giving us full details of the damaged or incorrect goods. We will accept returns of such damaged or incorrect goods notified to us in writing within the relevant time period and will give you the option of a refund or replacement goods. Refunds or replacement claimed outside of the relevant time period will be at our discretion. The goods should be sent back to us. Hi vis workwear will not accept returned goods that have been processed or decorated in any way.

Risk property and Insurance
All risk in the goods will pass to you including loss or destruction. Immediately upon the date when delivery takes place or when the goods leave our premises (if we are to deliver them to a third party at your request). The property in and title to the goods with not pass to you until we have received full payment of the amount due.

Warranties and payment
We undertake that the goods will, in all material respects, comply with any general description that we may have submitted to you, will be of satisfactory quality and reasonably fit for the purpose for which they were manufactured subject to normal usage. Unless specifically stated otherwise all garments are for leisure, and not for sport use.

Exclusion/Imitation of our liability to you
We will not be liable to you for loss of profits or a market or for any type of special indirect or consequential loss.

With the exception of death or personal injury caused by our negligence (which there are no limitation) our liability to you is limited to the invoice value of the goods which fail to comply with the express undertaking given conditions 6 above. You agree that, in return for the undertaking given in conditions 6 all warranties representations guarantees conditions and other terms, which would be implied into a supply agreement by law, are excluded.
